• ALISTAIR NICHOLSON: THE HICKS KANGAROO COURT
The Australian Criminal Code provides for a sentence to a term of imprisonment for 10 years for breach of the requirement to provide a fair trial.
The code has extra-territorial effect … the trial of Hicks before the second military commission [probably] constitutes a war crime … the difficulty for the leading members of the Australian Government is that under the Australian Criminal Code to "counsel" or "urge" another party to conduct a trial that does not meet the mandated standards can [also] constitute a war crime."-- Former Justice Alistair Nicholson

And remember ,its not all in the past, the Rudd government has the power and the duty to press criminal charges.
THe failure of the Rudd government to press these charges is criminal deriliction of their sworn duty to uphold the laws.
Ruddock no longer has that power BUT cerainly he should not be allowed to walk around with his head held high .

Excuse me, Terrorism was rampant when Ruddock was in power he had to be heavy handed because Australia was at War, Australia is not at War anymore, most troops have returned from Iraq lets remember him for what he had to deal with & move on from now & try to build peace again round the world.
