Well, seems that atrocity is swimming fast and reached a new low.
The Industrial Relations Commission (IRC) arranged that they would meet with TAFE and Crown Solicitors to give ‘directions’ re costs against Val. Alarmingly they told her “your attendance will not be required”
This appears to fly in the face of the evidence all the parties and judges hold, and completely ignore the justice application (application/notice for ex debito justitiae )

The letter may have been an attempt by the IRC to finalise/perfect the case instead of addressing the anomalies raised in the justice application/notice (See ‘perfecting’ the case in the application for ex debito justitiae).
While-ever the case remains unfinalised (i.e. not perfected) the judges can and should fix all their ‘mistakes’ and can and should revisit any part of the case to ensure that they are actually delivering justice
Of course they could have chosen to have done this in January, or at any time last year, or any time this year. But although we believe they should have, strangely, they have all, collectively, ignored the lot.
Judges who refuse to act appropriately bring the court into disrepute, and worse

"Your request to have the hearing of 24 March next adjourned has been noted as well as the reasons for your request.
"I wish to advise that the matter will remain listed before the Full Bench on 24 March next for directions only. The hearing scheduled for that date is vacated. Please be assured that your attendance will not be required. It is proposed that on that day, the Full Bench will utilise the time to give directions as appropriate to the New South Wales Technical and Further Education Commission, requiring it to obtain further instructions on the issue of costs between the parties.

Terrible news Jo. Costs would be hundreds of thousands of dollars what with Porky Brus and Skinny McKenzie representing the Crown. Val had right on her side yet she lost on their appeal; how could this happen unless the judges were instructed by the state government to make that finding.

When we don't have independent, honest, impartial judges willing to make judgments against the government WHAT HOPE HAVE WE GOT of getting any justice. The Val Kerrison and Gerard Crewdson cases are prime examples of judicial corruption. (Sue me if you want, I'm in Italy, I don't care).

Whistleblowers are punished in many ways for doing the right thing.

the certainty of having to sacrifice their own well-being and that of
their families. Aeroplanes will crash, resources will be wasted, and
corruption will run rampant as a
result. The trauma of victimisation ruins lives. This trauma is
expressed in many forms. Terrorism is one product of denial of access
to due process and natural justice. Destroyed and wasted lives,
billions of dollars of lost productivity, legal, and health care costs,
and toxic workplaces and a toxic society in general are some of the
'hidden' costs.
Perhaps more damaging is the reduction in that most valueable of all commodities, good will!

departmental propaganda, denial, and impression management, by
identifying that problems exist, and trying to address them. Teachers
suffer a huge amount of stress as a result. This costs our community
millions in terms of sick leave, stress leave, early retirement, and
the loss of the most talented teachers to other employers. Our most
vulnerable students are denied the basic right to a positive learning
environment, and a good education. Many schools in the N.S.W state
system are toxic workplaces and toxic places for students.
My personal experiences of victimisation
After
a number of bad experiences as a casual teacher I accepted a teaching
position that 19 other teachers had already rejected. The principal
asked for an economics teacher knowing full well that the teacher would
be teaching mostly geography. The Minister for Education finds no
problem in offering contracts in bad faith, and forcing teachers to
teach subjects they are not trained to teach, competent to teach, let
alone qualified to teach. When I followed the grievance procedures that
were in place I was victimised. One of the most sickening elements of
this victimisation was the deliberate strategy on the part of all those
involved, including the staff welfare officer, to collude and conspire
to have me defined as unfit for service by Healthquest. The Department
has a documented history of abusing pyschiatry to victimise
whistleblowers. An independant report into HealthQuest practises
detailed widespread serious abuses, and led to Healthquest being
disbanded, and replaced by an independant statuatory institution. I was
annuled and blacklisted. None of my grievances were ever investigated.
The IRC demonstated clear bias, and denied me the chance to appeal for
relief from unfair dismissal. The blacklisting resulted in me being
refused employment by every employer I have approached, including the
Tasmanian Education Dept. I have documented my experiences in detail in
"An education in victimisation". I have also given brief descriptions
of other experiences of victimisation that I have suffered.

I only just discovered marcus rehbach's horror account of experinces with NSW Dept of Education/HealthQuest I was struck in particular by their illegally seizing a ten year old lyric he wrote intended for a heavy metal song to use as evidence of his mental derangement...this all happening because he dared to complain about Dept deceitful practices-marcus-you won't be able to read this because you have been driven out of the country by this corruption but thank you all the same for the huge effort put in to record the details of your case-every such story is an important resource and back-up for other healthquest victims posted: gerard crewdson illegally removed from employment by HealthQuest 29/10/97

Marcus, I have just read your heartwrenching story. You have put so much work into exposing the corruption in the education department and if you are still about please let us know how you are - there are so many involved in this Healthquest scam and yet it is all covered up - your disturbing report of what they all did to you is criminal - they should all be charged. It is a horrific story of collusion at it's very worst. There are so many victims that this has happened to.
We applaud you for your courage and bravery to speak out as this only shows that you are not alone. Perhaps one day all victims will get the justice they deserve and all those who have committed this injustice will be exposed - it was disturbing to read the treatment you received at the hands of these thugs - it was also noticed that there was no union involved it would seem that this is something that is no surprise to any victim targetted. We all hope you are well - the pain and trauma you have suffered cannot be measured as you faced such a helpless situation with absolutely no support from anyone - we all suffer the same pain and trauma and know exactly how you feel and know the horror you faced - the lawyers are all as crooked as is the system they work for - this is how all victims are treated.
Stay strong as there are other victims right this very minute fighting for you to undue all the injustices done to all. This fight for justice needs to continue so please do not give up. The same has occurred to Val Kerrison (as you know) and another victim Gerard Crewdson who has also seen the ugly side of the judiaciary many times and have noticed that he has made a comment also about your case - they too continue to expose the wickedness and have for more than 10 years.

The discrimination, and victimisation against TAFE especially Ramsey and Willmott, and aiding and abetting cases against CSAH (HealthQuest) and NSW Health Dept (MAP) that were put off years ago are now going ahead in the ADT.

The site access to the information for Marcus Rehbach posted above is not accessible - does anyone know who may have stopped the access - could it be the the teachers federation union had something to do with this? - if anyone knows how to access it could they please update.

No, the crappy Teachers Federation had nothing to do with it.
Marcus' website is no longer available - perhaps he'll put his story
back up later on. However I think he told me that he received a
settlement from the Department on condition he did not publicise his
case - so maybe the DET solicitors made him take down the website.
Marcus lives overseas now, he is so disgusted with the happenings in
Australia.

Thanks for the information Pyewacket but I am confident that Marcus received nothing - as you mention it may happen that he will put the site back up again - I understand his lodgement for unfair dismissal was past the due date allowable-however circumstances which were clearely identified by Marcus state otherwise to the case itself listed before the IRC - it will always differ no matter what truth the victim portrays - I understand that Marcus refused to attend HealthQuest after finding out himself what it was about and required more time to understand why he was being sent there in the first instance. It just seems to be very strange that anyone involved with being HealthQuested doesn't seem to get justice in the IRC. You would think that alarm bells would be ringing somewhere but they seem to do the job they were appointed to do and that is to cover it up for the govt department responsible and allowed to do it over again.

yes alarm bells were ringing in the IRC in later 2000 early 2001 when in quick succession three victims of HEALTHQUEST political psychiatry sought to have their illegal examinations declared null and void-val Kerrison (TAFE) Pascale Bourot (DPWS) and myself (DOCS)...and no doubt the telephone line between the then President Lance Wright and his mate across the road Bob Carr buzzed because we certainly all got TELEPHONE JUSTICE...a charming term used in the Soviet Union to describe Stalinist Show Trials during the great purge-when the verdict would be relayed beforehand to the judge from the great man himself...Justice Boland did a particularly good job at putting the boot into me for daring to protect disabled in DOCS from abuse while at the same time he was reinstating police officers who had spent their workhours gazing at extreme pornographs-these decisions no doubt helped him when he was selected the new President of the iRC replacing lance wright gerard crewdson
