Magistrate Alison Viney Quits HealthQuest

Alison Viney, C.E.O. of HealthQuest, the N.S.W. Government Medical Office, has quit.

Viney was recently controversially appointed as a magistrate by the N.S.W. government. Considering her relative inexperience as a solictor doing court work, due to her commitment to HealthQuest over the last few years, it is not known why she was appointed to the Bench. As reported on Indymedia recently:

the government sector contains a very sinister statement:

It seems that 'those occupational health issues which just will not go away' might well be the troublesome whistleblowers and dissidents of the Public Service.

The attached document illustrates the kind of correspondence Alison Viney was involved in sending from HealthQuest. This document shows very clearly that Alison Viney was not only aware of public servants being forced to see psychiatrists and psychologists against their will, she was actively involved in the decision-making which has led to these events.

Viney has been replaced by Steven Davison. It is not known as yet what his background is but members of our team are looking into his past.

Viney approved referral to psychs

Well this document shows Viney approved of the referral of people to neuropsychologists and psychiatrists. Only a person's family doctor should be able to refer them to these kinds of specialists. If a person is not showing signs of mental illness, if they are not on medication for mental illness and not seeing a psychiatrist of their own, then why the hell are they being referred to these kinds of specialists. It is clearly harassment and victimisation and it happens mostly to whistleblowers. Add her to the Shame File. By the way, I wonder what happened to the former GMO Dr Helia Gapper who signed hundreds of certificates of insanity at HealthQuest. No-one has heard of her since she was stood down following the Lowe Report. And one final thing, Viney should not be a magistrate considering her involvement in HealthQuest and her lack of experience in court. This is another "Jobs for the Labor Government Supporters' promotion.

Waste of public funds

Notice how it says "Please advise whether the Department is prepared to cover the costs associated with these assessments." HealthQuest is a self-funded statutory body. It is no longer part of the State Government. This is very handy in that they are not subject to Privacy Laws any more so they can put whatever lies on your file they feel like and get away with it. Also it is important to HQ, being self-funded, to actually make some money. Hence these ridiculous demands for psychiatric assessments on people who are not mad in the first place. The cost of these things would be around $5,000. I wonder how much is being spent on HealthQuest assessments by various government departments and how much of this is even necessary. Even if a person was mentally ill, we still have antidiscrimination laws and they should not be refused employment. The employer has to make adjustments in the workplace for disabled people. So what's really going on here?

Corrupt Healthquest IS subject to PRIVACY

Who sez they aren't subject to privacy laws?  not only does the state government top up the shortfall in their funds, but the National Privacy Principles (Extracted from the Privacy Amendment (Private Sector) Act 2000)   http://www.privacy.gov.au/publications/npps01.html.  is very similar

1. Collection

1.1 An organisation must not collect personal information unless the information is necessary for one or more of its functions or activities.

1.2 An organisation must collect personal information only by lawful and fair means and not in an unreasonably intrusive way.

1.3 At or before the time (or, if that is not practicable, as soon as practicable after) an organisation collects personal information about an individual from the individual, the organisation must take reasonable steps to ensure that the individual is aware of:

(a) the identity of the organisation and how to contact it; and

(b) the fact that he or she is able to gain access to the information; and

(c) the purposes for which the information is collected; and

(d) the organisations (or the types of organisations) to which the organisation usually discloses information of that kind; and

(e) any law that requires the particular information to be collected; and

(f) the main consequences (if any) for the individual if all or part of the information is not provided.

1.4 If it is reasonable and practicable to do so, an organisation must collect personal information about an individual only from that individual.

1.5 If an organisation collects personal information about an individual from someone else, it must take reasonable steps to ensure that the individual is or has been made aware of the matters listed in subclause 1.3 except to the extent that making the individual aware of the matters would pose a serious threat to the life or health of any individual.

2. Use and disclosure

2.1 An organisation must not use or disclose personal information about an individual for a purpose (the secondary purpose) other than the primary purpose of collection unless:

(a) both of the following apply:

(i) the secondary purpose is related to the primary purpose of collection and, if the personal information is sensitive information, directly related to the primary purpose of collection;

(ii) the individual would reasonably expect the organisation to use or disclose the information for the secondary purpose; or

(b) the individual has consented to the use or disclosure; or

(c) if the information is not sensitive information and the use of the information is for the secondary purpose of direct marketing: ETC ETC

 

PLUS A LOT MORE TWADDLE WHICH IT IGNORES - ALONG WITH THE CORRUPT GOVT THAT SPAWNED IT.

 

 


I understand people who are well informed avoid Health Quest

Antino I have witnessed some small part of the battles honest citizens have with Tafe and NSW Health over several years. I am sure I was told by a veteran whistle blower. That anyone who expects to be directed to Health Quest by their employer should without delay and certainly not mentcioning it to the employer, get a certificate of good health, mental and physical from their own source. Which you can then produce to combat any unwelcome attempts to dismiss you from your job for medical or psychiatric reasons should you be a problematic whistle blower. There are plenty of us out here watching our unimpresive Government and their willing cronies.

Yes, I agree, it's a good idea to get a comprehensive certificate of fitness to refute any HealthQuest claims to the contrary. We are dealing with a criminal organization in my opinion.

years ago i was told by a woman working in police dept that when she protested at being ordered to shred documents that the Wood  Royal Commission wanted, she was told to go to HealthQuest.  She knew more than other whistelblowers did at the time because she knew that IF YOU WERE SENT TO HEALTHQUEST YOU DID NOT COME BACK.

Can an employer force an employee to attend a psychiatrist?

Case: Bliss v South East Thames Regional Authority

A leading case applicable to Australian employment law on this subject is Bliss v South East Thames Regional Authority (1987) ICR 700.

Bliss was an orthopaedic surgeon employed by .the SE Thames Regional Authority and was directed to attend a psychiatric examination after his employer received reports about his supposed mental instability    from a (duplicitous) colleague. Bliss refused and was suspended from his duties. He then claimed breach of contract by his employer .

"The Court of Appeal in finding for Bliss and against his employer
held:
"that it was an implied term of the plaintiff's contract of employment that the authority would not without reasonable cause conduct itself in a manner calculated or likely to damage or destroy the relationship of confidence and trust between the contracting parties; that in requiring the plaintiff to undergo a psychiatric examination when there was no mental or pathological illness but merely a severe degree of breakdown of personal relationships and in suspending him when he refused to submit to such an examination the defendant was in breach of that implied term and that the breach    going to the root of the contract was so fundamental as to constitute a repudiation of the contract of employment."

The judgement also states at 713 "There is no general power in an employer to require employees to undergo psychiatric examination."

URGENT - AVOID HEALTHQUEST AT ALL COSTS

ONCE YOU HAVE GONE TO HEALTHQUEST THEY HAVE YOU.  HEALTHQUEST CAN REQUEST THAT YOU BE SENT AGAIN AND AGAIN and charge the public purse for anything and everything they can think of to stick their noses into.  YOUR BULLY MANAGERS CAN AND DO  say they are "concerned" about you and send you to healthquest again and again and again.

HealthQuest and Privacy Laws

I have heard from someone who's very distressed over the evil things he found on his HealthQuest file some time ago. These false allegations go back more than 20 years. Over the years at various points he has asked HealthQuest (notably when Magistrate Alison Viney was CEO) to remove certain misinformation. They refused. Viney suggested that he attach to each disputed page a notation of his own to refute it. The Ombudsman was no use and thought this was a good idea. There was a court case in the IRC some years ago and the HealthQuest file was subpoenaed. None of his attachments were with the disputed pages. They had never been attached to them in the first place most likely.

Definitions

What is privacy?

Privacy has sometimes been described as:

  • the right to be left alone, or
  • the right to exercise control over one’s personal information, or
  • a set of conditions necessary to protect our individual dignity and autonomy.

We often think about privacy in different ways, for example:

  • physical privacy - such as bag searching, use of our DNA
  • information privacy – the way in which governments or organisations handle our personal information such as our age, address, sexual preference and so on.
  • freedom from excessive surveillance – our right to go about our daily lives without being surveilled or have all our actions caught on camera. More>>

What is personal information?

Personal information is any information or opinion about an identifiable person. This includes records containing your name, address, sex, etc., or physical information like fingerprints, body samples or your DNA. More>>

What is a public sector agency?

The term ‘public sector agency’ includes most State government departments and statutory authorities, and all local and county councils in NSW. State-owned corporations (such as RailCorp and Sydney Water) are not public sector agencies. Information protection principles at a glance

The 12 Information Protection Principles (IPPs) are your key to the Privacy and Personal Information Protection Act (and can be found in sections 8 to 19). They are legal obligations which describe what a NSW government agency must do when it collects, stores, uses and discloses your personal information.

However, in some cases, government agencies do not have to follow one or more of the IPPs, for example when information is being used for law enforcement. For more information about exemptions, contact the Privacy Contact Officer in the agency or Privacy NSW.

Collection

1. Lawful – when an agency collects your personal information, the information must be collected for a lawful purpose. It must also be directly related to the agency’s activities and necessary for that purpose.

 

MY COMMENT: THE COLLECTION OF INFORMATION BY HEALTHQUEST IN THE PAST HAS NOT BEEN FOR LAWFUL PURPOSE. IT HAS BEEN FOR THE PURPOSE OF CERTIFYING A PERSON INSANE WHO WAS IN FACT PERFECTLY WELL BUT HAVING SOME DISPUTE OR PROBLEM AT WORK. HEALTHQUEST SHOULD NOW DESTROY ALL THOSE ILLEGALLY COLLECTED FILES BUT RECENT INFORMATION SHOWS IT IS NOT DOING SO.

2. Direct – your information must be collected directly from you, unless you have given your consent otherwise. Parents and guardians can give consent for minors.

 

THE VICTIMS OF HEALTHQUEST DID NOT GIVE THEIR CONSENT TO THEIR GOVERNMENT DEPARTMENTS TO PLACE THESE TERRIBLE LIES, EXAGGERATIONS AND GOSSIP ON THEIR FILES. SO WHY ISN'T HEALTHQUEST NOW REMOVING ALL THESE THINGS?

3. Open – you must be informed that the information is being collected, why it is being collected and who will be storing and using it. The agency should also tell you how you can see and correct this information.

THE VICTIMS OF HEALTHQUEST WERE NOT TOLD WHAT WAS BEING SENT TO HEALTHQUEST UP UNTIL ABOUT 2 YEARS AGO. ALL THE INFORMATION COLLECTED BEFORE THIS SHOULD BE SHREDDED. SO WHY ISN'T THIS  HAPPENING?

4. Relevant – the agency must ensure that the information is relevant, accurate, up-to-date and not excessive. The collection should not unreasonably intrude into your personal affairs.

 

HEALTHQUEST FILES OF DISSIDENT PUBLIC SERVANTS DO NOT CONTAIN RELEVANT, ACCURATE OR UP TO DATE 'INFORMATION'. ALSO, THE INFORMATION IS VERY EXCESSIVE.

Storage

5. Secure – your information must be stored securely, not kept any longer than necessary, and disposed of appropriately. It should be protected from unauthorised access, use or disclosure.

 

HEALTHQUEST FILES ARE BEING KEPT FOR TWENTY YEARS OR MORE. WHY?

Access

6. Transparent – the agency must provide you with enough details about what personal information they are storing, why they are storing it and what rights you have to access it.

7. Accessible – the agency must allow you to access your personal information without unreasonable delay and expense.

8. Correct – the agency must allow you to update, correct or amend your personal information where necessary.

 

HEALTHQUEST WILL NOT ALLOW ITS VICTIMS TO UPDATE, CORRECT OR AMEND THE MISINFORMATION. ALISON VINEY CEO CONNED PEOPLE INTO THINKING SHE WAS ATTACHING STATEMENTS REFUTING THE LIES TO THESE VICTIMS' FILES. SHE WAS NOT.

Use

9. Accurate – agencies must make sure that your information is accurate before using it.

 

HEALTHQUEST HAS NEVER BOTHERED TO MAKE SURE THE INFORMATION IT HOLDS IS ACCURATE. A HEALTHQUEST FILE IS LIKE A KGB FILE, FULL OF FILTH.

10. Limited – agencies can only use your information for the purpose for which it was collected, for a directly related purpose, or for a purpose to which you have given your consent. It can also be used without your consent in order to deal with a serious and imminent threat to any person’s health or safety.

HEALTHQUEST IS USING THE 'INFORMATION' ON PEOPLE'S FILES TO ENSURE THEY ARE DENIED EMPLOYMENT IN THE FUTURE. HEALTHQUEST IS USING THIS INFORMATION TO DESTROY LIVES.

Disclosure

11. Restricted – the agency can only disclose your information with your consent or if you were told at the time they collected it from you that they would do so. The agency can also disclose your information if it is for a related purpose and they don’t think that you would object. Your information can also be used without your consent in order to deal with a serious and imminent threat to any person’s health or safety.

12. Safeguarded – the agency cannot disclose your sensitive personal information without your consent, for example information about your ethnic or racial origin, political opinions, religious or philosophical beliefs, health or sexual activities or trade union membership. It can only disclose sensitive information without your consent in order to deal with a serious and imminent threat to any person’s health or safety.

SO WHAT IS HEALTHQUEST GOING TO DO ABOUT THESE SERIOUS BREACHES OF THE PRIVACY LAWS? FOR EXAMPLE IT STILL HOLDS ALL THE LIES TOLD ABOUT VAL KERRISON. HOW SOON WILL THEY BE SHREDDED?

Val Kerrison's cases filed in the ADT are finally being allowed to be heard.  They are the discrimination and victimising cases against TAFE (especially Ramsey and Willmott), and aiding and abetting cases against CSAH (HealthQuest) and NSW Health Dept (MAP) .  Crown Solicitors and ADT put them off for years, but they are set down for hearing soon.
